ECA: Workers Compensation Products and Services

PRODUCTS AND SERVICES MEETING DIFFERENT LEGAL TESTS

ECA designs products and services to meet the particular business process, evidentiary and decision making needs of clients across a range of different areas of law.

While the product names are kept consistent across different areas to reflect the structure of the product, the specific content of the products and services varies by area of law to meet the different specific questions required to be answered in each area.

Products and Services designed to address the criteria under s32A of the Workers Compensation Act and the WorkCover Work Capacity Guidelines in a manner which will meet the requirements of Merit Review.

ECA Reports: Comprehensive integrated multi-disciplinary Earning Capacity Assessments; physical and psychological functional assessments; and vocational, labour market and "E" Earnings assessments.

Bookings: ECA can take care of all aspects of the booking process for you, including interpreters, travel and accommodation.

Post assessment services: ECA can seek the NTD's written response to work options; and / or a separate IMC contact and report.

Section 40: Assessments applying the criteria of s40 of the Workers Compensation Act, as it was, are also available for workers excluded from the 2012 amendments.

Physical + Vocational (LMA + Earnings) Assessment

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity where there are no psychological factors requiring assessment, combines and integrates the elements of the: Physical Functional + Vocational (Labour Market + Earnings) Assessments.

The Occupational Physician and Vocational Consultant liaise to identify work options which meet the s32A criteria of suitable employment. The Vocational Consultant also provides a Labour Market Assessment establishing that real suitable jobs exist and "E" the amount the worker is able to earn in each suitable work option.

Psychological + Vocational (LMA + Earnings) Assessment

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity where the impairments are purely psychological, combines and integrates the elements of the Psychological Functional + Vocational (Labour Market + Earnings) Assessments.

The Registered Psychologist and Vocational Consultant liaise to identify work options which meet the s32A criteria of suitable employment. The Vocational Consultant provides a Labour Market Assessment establishing that real jobs exist and "E" the amount the worker is able to earn in each suitable work option.

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity, combines and integrates the elements of the Physical Functional + Psychological Functional + Vocational (Labour Market + Earnings) Assessments.

The Vocational Consultant provides a Labour Market Assessment establishing that real jobs exist and "E" the amount the worker is able to earn in each suitable work option.

Section 40 Assessment
Any assessment can be ordered with a request that the law pursuant to section 40 be applied, for workers excluded from the 2012 amendments.

Particularly useful when you already have on file specific evidence of all physical, and/or psychological, restrictions required and of the capacity for hours of work within those restrictions, so a Vocational Consultant can rely on that material to select suitable work options without further input from a Medical Consultant or Registered Psychologist.

Vocational Assessment (LMA + Earnings) Assessment

A Vocational Consultant interviews the worker and assesses suitable work options taking into account the assumptions you provide regarding the worker's physical and/or psychological capacity for work and for hours of work.  
The report specifically addresses: education, training, employment, experience and transferable skills; work options identified as suitable employment and how and why each work option meets the s32A criteria; the Labour Market Assessment investigation (LMA) establishing that real jobs exist consistent with the worker's functional and vocational capacity including through employer contacts; and "E", the amount the worker is able to earn in each suitable work option.

Labour Market Assessment (+ Earnings) (Vocational Consultant)

A Vocational Consultant provided with functional restrictions and capacity for work as well as specific work options identified as s32A suitable employment then provides a report which addresses: the Labour Market Assessment (as above); and "E", the amount the worker is able to earn in each suitable work option.

Earnings Estimate Assessment (Vocational Consultant)

A Vocational Consultant provided with work options said to be s32A suitable employment provides a report which addresses: "E", amount the worker is able to earn in each suitable work option.

Physical Functional Assessment (Occupational Physician)

Particularly useful when the current Certificate of Capacity requires independent review and can be followed up by an IMC contact where appropriate.

An IMC accredited Occupational Physician examines the worker and assesses Medical & Physical functional work capacity. The report specifically addresses:  reasonable restrictions required; capacity for pre-injury work; capacity for any previously identified alternative suitable duties or work options; capacity for hours of work in some type of s32A suitable employment; prognosis; whether further investigations are required; effect of non-work related impairments on work capacity; appropriateness of the current certificate of capacity; and whether an IMC telephone contact and report would be appropriate.

Psychological Functional Assessment (Registered Psychologist)

Particularly useful when psychological factors are said to be impacting on a return to work.

A Registered Psychologist interviews the worker and assesses Psychological functional work capacity.

The report specifically addresses: reasonable psychological restrictions required; capacity for pre-injury work; and psychological capacity for hours of work in some type of s32A suitable employment.

NTD Response to Assessment

ECA can fax the relevant findings to the NTD seeking their written agreement or response.

IMC Telephone Consultation and Report

An IMC Telephone consultation by an IMC accredited Occupational Physician pursuant to the WorkCover IMC Guidelines may be appropriate where the result of any Assessment is not consistent with the current certificate of capacity or there are other IMC issues.

Appointment: ECA can contact the worker to book a mutually convenient assessment time and date within the given time range, and prepare all written confirmations in accordance with s44A.

Interpreter: ECA can book an appropriate interpreter.

Flights and accommodation: ECA can book flights and accommodation.
