ECA: Work Injury Damages Products and Services

PRODUCTS AND SERVICES MEETING DIFFERENT LEGAL TESTS

ECA designs products and services to meet the particular business process, evidentiary and decision making needs of clients across a range of different areas of law.

While the product names are kept consistent across different areas to reflect the structure of the product, the specific content of the products and services varies by area of law to meet the different specific questions required to be answered in each area.

Products and Services designed to address the modified common law criteria relevant to s151G of the Workers Compensation Act.

ECA provides comprehensive earning capacity assessments, vocational assessments, labour market and earnings assessments, as well as stand alone physical and psychological functional assessments to address specific issues around capacity for work.

Physical + Vocational (LMA + Earnings) Assessment

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity where there are no psychological factors requiring assessment, combines and integrates the elements of the: Physical Functional + Vocational (Labour Market + Earnings) Assessments.

The Occupational Physician and Vocational Consultant liaise to identify work options which meet the criteria of suitable employment. The Vocational Consultant provides a Labour Market Assessment establishing that real jobs which the worker could do exist in the reasonably accessible labour market and the amount the worker is able to earn in each suitable work option.

Psychological + Vocational (LMA + Earnings) Assessment

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity where the impairments are purely psychological, combines and integrates the elements of the: Psychological Functional + Vocational (Labour Market + Earnings) Assessments.

The Registered Psychologist and Vocational Consultant liaise to identify work options which meet the criteria of suitable employment. The Vocational Consultant provides a Labour Market Assessment establishing that real jobs which the worker could do exist in the reasonably accessible labour market and the amount the worker is able to earn in each suitable work option.

Physical + Psychological + Vocational (LMA + Earnings) Assessment

This comprehensive multi-disciplinary assessment, which addresses all issues relevant to earning capacity, combines and integrates the elements of the: Physical Functional + Psychological Functional + Vocational (Labour Market + Earnings) Assessments.

The Occupational Physician, Registered Psychologist and Vocational Consultant liaise to identify work options which meet the criteria of suitable employment. The Vocational Consultant provides a Labour Market Assessment establishing that real jobs which the worker could do exist in the reasonably accessible labour market and the amount the worker is able to earn in each suitable work option.

These assessments are particularly useful when you already have specific evidence of all physical and/or psychological restrictions required to allow the worker to work, and of the worker's capacity for hours of work within those restrictions, so that a Vocational Consultant can rely on that material to select suitable work options without further input from a Medical Consultant or Registered Psychologist.

Vocational Assessment (LMA + Earnings) by Vocational Consultant

A Vocational Consultant interviews the worker and assesses suitable work options taking into account the assumptions you provide regarding the worker's physical and/or psychological capacity for work and for hours of work.

The report specifically addresses: education, training, employment, experience and transferable skills; work options identified as suitable employment and how and why each work option meets the criteria of suitable employment; the Labour Market Assessment investigation (LMA) establishing that real jobs exist consistent with the worker's functional and vocational capacity including through employer contacts; and the amount the worker is able to earn in each suitable work option.

Labour Market Assessment (+ Earnings) by Vocational Consultant

A Vocational Consultant provided with identified work options provides a Labour Market Assessment investigation (LMA) establishing that real jobs exist consistent with the worker's functional and vocational capacity; and the amount the worker is able to earn in each suitable work option.

Earning Estimate Assessment by Vocational Consultant

A Vocational Consultant provided with identified work options provides an Earnings report which addresses the amount the worker is able to earn in each of the identified work options. This report can be used to obtain updated earnings information where the suitability of work options and the Labour Market Analysis does not require review.

These assessments are useful when a specific review of a worker's current Capacity to Work is required. A review of current Capacity to Work can then form the basis for further investigations including a Vocational Assessment, Labour Market and/ or Earnings Assessment.

Physical Functional Assessment by Occupational Physician

An Occupational Physician examines the worker and assesses physical functional work capacity. The report specifically addresses: reasonable restrictions required; capacity for pre-injury work or identified alternative suitable duties; capacity for hours of work in some type of suitable employment; prognosis; effect of non-work related impairments on work capacity; and appropriateness of the current certificate of capacity.

Psychological Functional Assessment by Registered Psychologist

A Registered Psychologist interviews the worker and assesses psychological functional work capacity. The report specifically addresses: reasonable psychological restrictions required; capacity for pre-injury work; and psychological capacity for hours of work in some type of suitable employment.

NTD Response to Assessment

ECA can fax the relevant findings to the NTD seeking their written agreement or response pursuant to the Claim Form Authority.
